REGO COSTA & TAVARES Lda – ILHA VERDE RENT A CAR, is a private limited company incorporated in the Autonomous Region of the Azores, with a share capital of EUR 1,995,200.00 and headquartered in Campo de São Francisco nº 9, in Ponta Delgada, with a corporate identification number 512005150, registered at the Ponta Delgada Registry Office, under the same number of legal person, hereinafter referred to only as “ILHA VERDE”.

In accordance with these General Rental Terms and Conditions (T&C), Ilha Verde is obliged to fulfill the following duties:

  • Rent a Vehicle (light passenger or commercial) to the person indicated in the Rental Agreement, who signs, as indicated below, for the period of time not exceeding 30 days, specified in the Rental Agreement in “Rental Period”, plus accessories you want to rent, which must also be specified in the same contract.
  • Provide certain mobility services integrated in all of our rentals and offer you other services that are available at an extra cost.

The contractual relationship established between the Lessee and Ilha Verde is regulated by the following documents:

  • The “Rental Agreement” and its specific clauses in the document signed by the Lessee at the time of pick up of the vehicle “check-out” or on the first day of the rental;
  • The booking confirmation email, if you previously booked the rental “on line”;
  • The Ilha Verde Insurance and Protection Products Guide;
  • The Recommended Cost Tariff;
  • The “T&C” that apply to those documents.

In case of contradiction between any of the documents mentioned above, the terms of the first document referred to prevail.

1) TO WHOM THE “RENTAL TERMS AND CONDITIONS” ARE INTENDED”

The “T&C” is intended for the person who pays the rental and associated costs, and may also be the driver, as well as any other driver, who is expressly indicated in the Rental Agreement, and, as such, is authorized to drive the vehicle.

All persons indicated in the Rental Agreement are responsible for the payment of any amounts due under the same.

2) WHO RENT IS ALLOWED AND WHO CAN DRIVE

a) Who is allowed to rent a car?

Any individual who:

  • Be legally able to sign a contract with Ilha Verde and be prepared to take responsibility for the vehicle during the Rental Period.
  • Have indicated the means to pay the car rental and additional costs to Ilha Verde (as shown in the table below);
  • Credit and debit cards in the name of the driver or drivers indicated in the contract.
  • Credit Cards (Visa, MasterCard, American Express, Diners) and or Debit cards. Virtual, prepaid or top-up credit cards – or any other card on which the characters are not embossed are not accepted.

b) Who can be a “Driver”

An Authorized Car Driver is any individual who meets all of the following requirements:

  • Be expressly and completely identified in the Rental Agreement or in any document attached to it (which may also be the lessee);
  • Hold a valid driving license and identification documents (national identification or passport);
  • Hold a valid driving license, for a period of time that may vary according to the category of the vehicle, minimum 1 year of the issue and, or the age of the Driver;

c) Who cannot drive

Anyone who is not expressly mentioned / identified in the Rental Agreement is not authorized to drive the Vehicle.

Likewise, any person who does not carry the valid identification documents mentioned in sections, 2a) and 2b).

The permission to drive to an unauthorized person implies the violation of the “T&C” and the responsibility for any consequences that result, including the possibility to answer before Ilha Verde for the damages caused or caused by the unauthorized person.

In these circumstances, neither the renter nor the unauthorized driver will be covered by any insurance or protection product offered through Ilha Verde, except for mandatory civil liability insurance.

3) DRIVING IS ALLOWED

You can drive the light passenger vehicle in the Azores Archipelago, by communicating to Ilha Verde. Light goods vehicles cannot travel throughout the Archipelago, unless authorized by Ilha Verde.

Car return is not permitted on islands where rental has not started. Other mobility services are proposed. Please contact our Reservations Department for more information.

4) TYPES OF VEHICLES AND PURPOSE

You can rent a passenger car or freight car and you must drive them according to your own purpose, under the following terms:

  • Passenger vehicles have the purpose of transporting a variable number of people (depending on the capacity, authorized in the Single Automobile Document) and,
  • Goods vehicles (commercial) can be used to transport goods up to the weight limit, resulting from the Single Automobile Document.

Ilha Verde does not cover the goods transported in the Vehicles and cannot be held responsible for any goods or objects left in it. Ilha Verde is also not responsible for lost profits or operating losses incurred during the rental period.

5) OBLIGATIONS TO THE VEHICLE

When renting a car on Ilha Verde, or any Driver, they must comply with the following obligations:

  • Return the vehicle and the respective keys, accessories and documents to Ilha Verde, at the return station, indicated in the Rental Agreement, at the time and date of the rental term, as recorded in the Contract, and in the same state in which you received it , at the beginning of the Rental Period. If the vehicle is not returned under the terms referred to, Ilha Verde may take the measures provided for in clause 11 of these “T&C”, “Procedures when returning the vehicle”.
  • As a renter or any driver, you cannot drive the vehicle outside the island, where you rented. If you intend and / or any driver to take the vehicle to another island, you must inform Ilha Verde, and in that case, you must ensure that it has the appropriate and necessary equipment to another destination that you intend to go to.
  • You and / or any Driver must drive, under reasonable conditions, in accordance with the Highway Code, applicable traffic laws and regulations and must ensure that they are familiar with local traffic and driving rules.
  • You must confirm that any baggage or goods carried in the Vehicle are safe so as not to cause damage or cause risks to the occupants as well as to other road users.
  • You and / or any Driver must take care of the Car with all due diligence. Always ensure that it is closed and protected with anti-theft devices when it is parked or unattended.
  • Never and / or any Driver should drive while under the influence of alcohol, drugs, hallucinogens, narcotics, barbiturates, other illegal drugs or any substance (legal or illegal), which is likely to affect or impair the ability to drive and / or any Driver.
  • Any driver must refuel the vehicle with the appropriate type of fuel. If the Vehicle is refueled with the wrong fuel, it will be responsible for any costs incurred in moving it and / or repairing the Damage caused, calculated in accordance with the rules described below (see Damage to the Vehicle), unless it demonstrates that the error was attributable to a third party.
  • You may not and / or any Driver use the Vehicle or allow it to be used for:
  • The sub-lease, mortgage, pledge, sale or any kind of guarantee, whether in relation to the Vehicle as a whole or to any of its components, as well as the Rental Agreement, keys, documents, tools, or any of its accessories;
  • Transport passengers on behalf of others or against payment;
  • Transporting occupants that exceed the capacity permitted by the Single Automobile Document;
  • Transporting goods with weight, in quantity and / or volume that exceeds that authorized by law and the Single Automobile Document;
  • Transporting flammable, or dangerous, toxic goods, harmful and / or radioactive products or which are illegal, (provided that such exclusion does not prevent you from meeting the lawful daily needs and whose transport corresponds to the normal use of the Vehicle);
  • O sports events, off-road, confidence tests, speed tests, to be part of rallies, contests, or rehearsals, Regardless of the location, official or not;
  • Transporting live animals (except pets or pets, with written and express authorization from Ilha Verde);
  • Giving driving lessons or “accompanied driving”;
  • O to push or pull another vehicle or trailer, unless the rented Vehicle is equipped with a towing coupling / coupling device and for the towable gross weight that is properly registered;
  • O on dirt / gravel roads or on roads whose surface, size or condition involves risk to the Vehicle, such as beaches, unsuitable roads, forest paths, mountains, etc., or any unauthorized or paved roads, except for categories Vehicles with authorization for this purpose;
  • O to commit a willful offense;
  • O to be carried on board any type of boat, ship, lorry, except with the express consent of Ilha Verde;
  • O within lanes not allowed for transit at ports, airports, and / or aerodromes and / or similar or similar places, not accessible to public transit, without the express and written consent of Ilha Verde. If Ilha Verde authorizes under the terms mentioned, it will inform you of the civil liability insurance that is applicable in these cases and that varies according to the circumstances.

During the Rental, you must take all necessary protective measures to keep the Vehicle in the same condition as it was delivered to you. In particular, you and / or any Driver should regularly check the condition of the vehicle for oil levels, water and tire pressure. You can be held liable, before Ilha Verde, for the losses that result from the breach of any of the mentioned obligations. Please note that failure to comply with any of the obligations mentioned above also implies the ineffectiveness and inapplicability of any limitations or exclusions of liability to which you were entitled under optional insurance or other protection products.

Ilha Verde also reserves the right to demand the immediate return of the Vehicle.

8) PRICE INCLUDES

The information you provide to Ilha Verde at the time of booking (such as the length of the rental, your age or the age of the additional Driver) will change the amount payable. Any change to that information may, as a result, change that price. The rental price will be the one in force at the time of booking or at the time you make any subsequent changes to the booking.

  • The price you pay includes the following costs:
  • The daily rental value of the Car for the contracted calendar days, calculated for periods of 24 Hours (which includes the standard mobility services referred to above);
  • The value of any other additional mobility services you intend to hire;
  • The applicable tax (VAT);
  • Other costs associated with it (for example: age, if you are a Young Driver).
  • When contracting with Ilha Verde, you authorize to debit any unpaid amount resulting from the rental from the available means of payment. For this purpose, express consent will be given at the Ilha Verde station, when providing the payment method, before collecting the car.

9) OTHER AMOUNTS PAYABLE

  • The Deposit / Security Deposit. In addition to the rental price (which you paid in advance at the time of booking or you will pay at the time of collection), Ilha Verde requires that you leave a guarantee for any additional costs that may result from the rental period.This guarantee is provided in the form of deposit in the form of bank pre-authorization. In case you have reserved the car, with Ilha Verde, by means of remote communication (website, mobile application or phone) the amount of the deposit will be reminded in the confirmation email you receive after your reservation. Please note that the deposit amount will be remembered again at Ilha Verde station. You can find more information about the security in clause 19 (“Deposit / Security before collecting the Car”).
  • Ilha Verde may also charge you for services or costs that you have to perform or bear because of incidents that may have occurred during the Rental Period and / or the way you used the Car.The value (including VAT) of these services or costs are described in the SERVICE SUPPLEMENTS, INSURANCE AND COMPLEMENTARY PROTECTION RATES, OTHER EXTRAS, attached to your confirmation email (if you have chosen to book online with Ilha Verde) and / or, which was made available on the website or at Ilha Verde station.

Such services and costs include, without limitation:

  • Administrative costs for the management of fines processes, in the amount of Euros 35.40, per process. Note that such administrative costs are paid in addition to the fines they refer to and for which you are fully and exclusively responsible;
  • O Administrative costs for the management of the process, in case of damages, in the amount of Euros 59.00;
  • The cost of cleaning the vehicle on the outside and inside due to dirt;
  • The cost of lost or stolen keys;
  • The “Damage” caused to the Vehicle (any material damage or vandalism caused to the Vehicle) and / or “Theft of the Vehicle” (theft and / or attempted theft of the Vehicle or its components). Your liability may be limited, under the terms and according to the type of protection you have chosen (please check the Ilha Verde Insurance and Protection Guide, attached to the confirmation email or available on the website or at any Ilha Verde station);
  • The cost of fuel used during the Rental Period;
  • The cost of refueling, in case you do not return the full tank;
  • Additional kilometers in addition to those that were included in your rental price if applicable);
  • The cost of the NAV device (GPS) in case of disappearance or damage;
  • Late cancellation: If you cancel the rental within 48 hours after the pick-up time, a fee of up to € 59.00 may be applied for “Late cancellation”. The amount of this fee will not exceed the price of your rental, if it is lower. In case of pre-paid reservation, the amount will be refunded, being deducted the “Late Cancellation” fee. In case of booking not paid in advance, the fee will be deducted from the payment method you have provided. In case of booking not paid in advance, and in the absence of provision of means of payment, you will continue to be responsible for paying the “Late Cancellation” fee.
  • O No Show (“No Show”): If you have not cancelled your reservation and do not show up at the Agency to collect your vehicle at the scheduled time, a “No Show” fee of up to € 59.00 may be applied. of the rental is less than the amount of the “No Show” fee, the fee will be equal to the rental price. In case of pre-paid reservation, the amount will be refunded, less the “No Show” fee. In case of unpaid booking, the fee will be deducted from the payment method you have provided. In case of unpaid booking, in the absence of means of payment, you will continue to be responsible for paying the “No Show” fee.
  • O The following specific additional costs: for withdrawals or returns at stations located at airports or at gares, docks and ports stations, if applicable, of the return of the Vehicle to an Ilha Verde station other than the one where the collection was made (“One Way” ) the extension of the rental.

10) PROCEDURES WHEN LIFTING THE VEHICLE

When you pick up The Car, near Ilha Verde, you will be asked to sign, in addition to others, an additional document to the Rental Contract that describes the condition of the Car at that time.

If you notice any apparent anomaly or Damage that is not described in the Rental Agreement, you must ensure that this is mentioned in the document and that both the lessee and the representative of Ilha Verde sign such change. In the event that nothing is mentioned, it is considered that the Vehicle that was delivered to you in the state referred to in the Rental Agreement or in the additional document. You will be charged for any new Damage that is verified by you and the representative of Ilha Verde when the Vehicle is inspected by both parties at the time of its return.

If you identify pre-existing damage to the rental, which has not been included in the description of the vehicle’s condition, and you cannot find any representative of Ilha Verde on the spot, you can report them to Ilha Verde within 12 hours after leaving the station.

11) PROCEDURES WHEN RETURNING THE VEHICLE

a) Return of the Vehicle during the opening hours of the Ilha Verde Stations

You must return the car at Ilha Verde station on the date and time indicated in the Rental Agreement. If you want to return the car at another Ilha Verde station, consult the Recommended Cost Tariff, attached to your confirmation email, in case you made the reservation by remote means, this document can be consulted at the stations or on the Ilha Verde website.

The Rental Period ends when you return the Vehicle at Ilha Verde station and deliver the respective key and the documents of the Vehicle to an Ilha Verde representative or in the Drop off Box, if any.

If you return the Vehicle before the date mentioned in the Rental Agreement, you will not be entitled to any refund.

When returning the vehicle to Ilha Verde you must inspect it together with the Ilha Verde representative and sign the post rental damage report.

Ilha Verde will not be responsible for any goods or objects that you may have left in the Vehicle.

b) Return of the Vehicle outside the opening hours of Ilha Verde Stations (“Out of Hours”)

Ilha Verde recommends that the return of the vehicle be made during the opening hours of the stations. However, to meet the specific needs of customers, Ilha Verde offers, in certain seasons, the additional service “Out of Hours”.

In the case of opting for this “Out of Hours” service, you accept that the report confirming the status of the vehicle is prepared by the representative of Ilha Verde, without your presence, and after handing over the keys. In stations offering the “Out of Hours” service, the vehicle return procedure described above (11th) is adapted, so that this service is provided in the best possible conditions.

You must declare any incident and, or Damage that affects the condition of the vehicle, in the Document delivered to you, for this purpose, at the beginning of the rental.

This document must be left in the vehicle or returned, together with the keys, to the “Drop box”, depending on the systems available and the information you receive from Ilha Verde.

Please note that your Rental Agreement does not end when you hand over the keys. Ilha Verde recommends that you park the car in the company park and in such a way that it does not cause danger to others or disturb traffic, complying with the Highway Code. You must also leave the vehicle documents in the glove compartment.

Bearing in mind that the vehicle will be inspected at a later stage than its delivery – during the opening hours of the station – Ilha Verde recommends that you take photographs, as proof of the state of the same, at the time of parking and before delivery of the keys.

After the inspection has been carried out and in the absence of any damage, Ilha Verde will send the Vehicle Return Declaration.

Green Island will not be responsible for any goods or objects that you may have forgotten in the Vehicle.

c) Return of the Vehicle, not in person, during the opening hours of Ilha Verde Stations.

In the event that it is not possible and or, if you refuse to inspect the Vehicle with the representative of Ilha Verde, the latter is authorized to inspect it, without your presence, and to register your refusal to the adversary.

In this situation, the same procedure referred to in 11 b) applies.

d) Delay in returning the vehicle.

In the event that the Vehicle is not returned on the date mentioned in the Rental Agreement and if there is no information in the 24-hour period justifying the delay in returning it, Ilha Verde reserves the right to:

  • Considering that you have appropriated the Vehicle illegally and will report it to the competent local authorities.
  • Charge the rental price for each day you stay with the Car beyond the date of the rental term, plus compensation equivalent to twice the amount to be paid, unless you demonstrate that you no longer own the Car or that the failure to refund it will result in fact that is not attributable to it.
  • Claim your responsibility for all damages and losses suffered, as well as the fines, fines or other sanctions or penalties that fall on the Vehicle as a result of the proceedings initiated by public authorities, in order to identify the infringer or to clarify other circumstances related to non-compliance or criminal offense.
  • Initiate the legal proceedings necessary to claim the immediate return of the Vehicle.

Note that in this case, the protections, optional insurance and additional services contracted will have no effect.

12) CAR DAMAGE

In the event that the Vehicle is not returned in the same condition in which it was delivered, you will be responsible for the amounts mentioned below:

a) Damage identified, in person, at the time of returning the Vehicle.

In the event of Damage being identified in the scope of the inspection carried out, in person, and that of the Ilha Verde representative when returning the Vehicle and of which you became aware when you signed the document (Addendum) and the post rental damage report, Ilha Verde will deliver an assessment of the repair costs that may be charged to you.

Repair costs vary, depending on the nature of the Damage:

  • “Small Damage” (minor and non-substantial damage caused to the Vehicle, without affecting its return to the Lessor and without affecting its mobility under the terms of the Highway Code, such as and without limiting, small risks or dents in the windshield ) are charged according to the price list indicated by Ilha Verde, available at any Ilha Verde station and on our website at the following address: Recommended Price for Small Damages, which include the cost of the vehicle’s immobilization, together with the administrative costs of damage management..
  • Any other damages not included in the above list and / or other more serious damages (substantial damages that prevent the return of the Vehicle and require its temporary immobilization for repair, such as and without limitation: damage to the body), will be evaluated by a expert and charged according to the expert’s report or the budgeted cost of a repair shop.

In case of contesting the Damages and, or the respective billing, through the refusal to sign the Declaration of Return of the Vehicle, Ilha Verde will apply the procedure described below in (12b).

b) Damages identified in case of “Out of Hours” and not in person return.

In the event that the Damage is identified within the scope of the inspection of the Vehicle carried out by the representative of Ilha Verde without his presence, Ilha Verde will send the following documents:

  • Vehicle Return Declaration with description of the identified Damages;;
  • Damage photographs;
  • An estimate (budget) of the repair costs, which will depend on the nature of the Damage (see above 12a), the costs of immobilizing the Vehicle and the administrative costs for managing the Damage process.

You can contest the identified Damages and the respective billing within (14) fourteen calendar days after sending the documents, by email to customerservice@ilhaverde.com, or by letter to Campo de São Francisco nº 9 9500-153, Ponta Delgada . In the event of non-contestation, within the said period of 14 days, Ilha Verde reserves the right to charge you for the said costs.

c) General rules

Please note that, depending on the Damage suffered by the Vehicle and the type of protection you have subscribed with Ilha Verde, check out the Ilha Verde Insurance and Protection Guide attached to Your confirmation email or available on the website or at any Ilha Verde station, it can be or not charged for the full amount of the repair cost.

In any case, you can contest the Damages and, or the respective billing, under the terms referred to in paragraph b, without prejudice to being able to always complain to the competent jurisdictional means (Clause 23) “Case of litigation related to the rental”).

13) CAR MAINTENANCE PROCEDURES

During the rental you must take all necessary protective measures to keep the car in the same condition as it was delivered.

You should watch for any warning signals from the instrument panel lights and take the necessary safety measures.

The vehicle is supplied with tires, in number and under conditions that comply with the requirements of the laws of the Highway Code. Should any of them suffer damage, in addition to normal wear and tear, latent defect or force majeure, it will be obliged to replace immediately, at your expense, with a tire of the same dimensions, type and brand.

Any modification or mechanical intervention on the vehicle is prohibited without the prior written authorization of Ilha Verde. In case of violation of this rule, you will have to bear the costs of replacing the Vehicle in the same conditions as it was delivered to you and will be liable to Ilha Verde for any losses resulting from the violation of the conditions mentioned above, regarding maintenance obligations.

14) PROCEDURES IN CASE OF ACCIDENT, MECHANICAL FAILURE OR THEFT

  • In the event of a mechanical breakdown or accident, which prevents you from continuing to drive and / or which requires trimming to avoid aggravating the damage, an assistance service is available, included in the rental price. The terms of this assistance are described in Annex I of this “T&C”.
  • In the event of an accident, you must immediately communicate to Ilha Verde and call the local police authorities and complete the Friendly Declaration of Automobile Accident.
  • In these cases, you must contact the assistance service that is included in the rental price, for the number that is indicated on the windshield.
  • In the event of theft of the vehicle, you must submit to Ilha Verde a copy of its participation to the police authorities, within 12 hours, together with the keys and documents of the vehicle, if you have them.

15) RENTAL INVOICE AND PAYMENT

The invoice will be issued as soon as all the elements of the Rental are completed and never before the day after the return of the Vehicle.

  • You can choose to prepay the rental, in the reservation made “on line”, via the reservations department or at an Ilha Verde station, which will include the daily rental value of the Vehicle and accessories for the Rental Period, as well as any rental services. additional mobility. The agreed amount will be debited from the payment method indicated and you will receive an invoice or a receipt for the prepayment. Finally, the prepaid amount will be mentioned on the final invoice and deducted from the total amount that you may still have to pay.
  • If you do not choose to prepay at the time of booking, the amount of the deposit, the costs of renting the Vehicle and accessories, any additional services or drivers or any cover you decide to subscribe to, will be detailed in the Rental Agreement and accepted , before proceeding with the signature and the survey of the Vehicle. The final rental costs will be charged and billed at the time of returning the Vehicle, at the end of the Rental Period.

Any additional fees or costs will be charged when returning the Vehicle (if they can be calculated at the time).

If you have incurred extra costs, such as fines and or Damage to the identified Vehicle, without your presence, Ilha Verde will charge you, along with the respective administrative costs (for managing the fines and damage management processes) more later when you become aware of them.

In this case, you will have 15 working days, from the date of sending the billing notification, to contest and, or justify not being responsible for the management costs, you can do so through email to customerservice@ilhaverde.com, or by letter to, Campo de San Francisco, 9, 9500-153 Ponta Delgada. If not mentioned in the challenge period you will be charged the amount of said administrative costs.

The invoice will be sent electronically to the email address you provided for this purpose. If you do not want to receive the invoice electronically, you can choose to receive it on paper.

If the payment date indicated on the invoice to win expressly agree that:

  • This implies the immediate and full maturity of all unpaid invoices and the termination of the Rental Agreement and Ilha Verde will have the right to immediately demand the return of the Car and will have to pay default interest at the legal rate.

In the event that the Rental Agreement is signed under a Commercial Agreement, the respective company will be responsible for paying the invoice.

16) PROCEDURES FOR CANCELING OR CHANGING THE RESERVATION

a) Changes

You can change your reservation, free of charge, as long as you inform Ilha Verde of such changes, at least 48 hours, before the rental is scheduled to start.

Please note that if you change your reservation, new rental prices may apply and you should always use the same communication channel previously used when you made the reservation for the vehicle. Alternatively, you can call our Call Center, number: + 351 296 304 891.

b) Cancellation and no show

  • Cancellation – You can cancel your reservation free of charge, with notice to Ilha Verde, 48 hours in advance, regarding the collection time.
  • Late cancellation – If you cancel your reservation with less than 48 hours’ notice to Ilha Verde, a fee of up to € 59 may apply. The amount of this fee cannot exceed the rental price, if it is lower. In case of pre-paid reservation, the amount will be refunded, being deducted the “Late Cancellation” fee. In case of unpaid booking, the fee will be deducted from the indicated payment method. In case of unpaid reservation, and in the absence of provision of means of payment, you will continue to be responsible for paying the “Late Cancellation” fee.
  • No Show (“No Show”) – If you have not canceled the reservation and do not show up at the agency to collect the vehicle at the scheduled time, a “No Show” fee of up to € 59 may apply. If the rental price is less than the amount of the “No Show” fee, the fee will be equal to the rental price. In case of pre-paid reservation, the amount will be refunded, less the “No Show” fee. In case of unpaid booking, the fee will be deducted from the payment method you have indicated. In case of unpaid booking, in the absence of means of payment, you will remain responsible for paying the “No Show” fee, unless you can demonstrate verification of a “Force Majeure” case, as defined below, or you will pay the full rental price, if the value is lower.

For due effects, the cancellation of the reservation or the non-lifting of the Vehicle, due to causes of force majeure, such as acts of war and other civil hostilities and commotions, accidents, strikes, lock-outs, or other labor conflicts, embargoes or governmental decisions on restrictions on circulation, imports or exports or any other cause or circumstance that cannot be controlled (directly or indirectly).

17) PROCEDURES FOR EXTENDING THE RENTAL AGREEMENT

In case you want to extend the Rental Period provided for in the Rental Agreement, you must proceed as follows:

  • Contact the Ilha Verde station to return the vehicle;
  • Go to the nearest Ilha Verde station indicated to you;
  • Carry out an inspection of the vehicle with the representative Ilha Verde;
  • Sign an amendment to the Contract or a new Rental Contract, depending on what applies to it;
  • In case you want to change the rental conditions, in addition to signing a new Contract, you must settle the previous rental and the associated costs.

If you do not follow the steps above and keep the Car, the provisions of clause 11 d) apply: “Delay in returning the Car”.

18) FUEL

The rules applicable to fueling and refueling depend on the type of rental you choose. Please check the applicable fuel rules for each rental you make.

All vehicles are delivered with a tank full of gasoline or diesel fuel. When returning the Vehicle, the following situations may occur:

1) Full to Full

  • Ilha Verde delivers the vehicle with a tank full of fuel, gasoline or diesel, at the level mentioned in the Rental Agreement.
  • You must return the vehicle with the same level of fuel and you will not pay for refueling or fuel.
  • If you do not return the vehicle with the same fuel level indicated, at the time of delivery, you will be charged for the cost of the missing fuel, plus an amount corresponding to the cost of refueling (See the Supplement Tariff for service, Insurance and Complementary Protection, other Extras), along with the confirmation email and available on the website or at Ilha Verde stations.

2) Fuel Tank Purchase

  • When collecting the vehicle, you have the possibility to pay the price of a full fuel tank. This cost will depend on the vehicle category.
  • In this case, you can return the vehicle, regardless of the fuel level you currently have. Ilha Verde will not charge you any additional amount, but will not reimburse you for unused fuel.

3) EZFUEL

  • For Rental Contracts of less than 100 km, unless the proof of supply is presented.

19) DEPOSIT / SECURITY BEFORE LIFTING THE VEHICLE

When you pick up the Vehicle, allow a credit and / or debit card authorization for a deposit. The deposit is intended to cover rental costs, additional costs and or other inherent costs.

If the prepayment is not made at the time of booking, the cost of the rental will also be blocked on your credit card. In this case, the blocked amount will correspond to the cost of the rental and the value of the deductible according to the insurance contracted. In any case, the final deposit amount is specified in the confirmation email sent to you at the time of booking and in the Rental Agreement. Please note that in case of prepayment, if you make a purchase over the counter, the amount will be added to the deposit amount. If no additional rental costs are identified, the deposit will be refunded, within the period agreed between the renter and the bank.

The deposit must be made by the renter or by an additional driver, duly identified, in the Rental Agreement and must present the same credit / debit card indicated at the time of booking or another in the name of the renter or an additional driver.

20) PAYMENT WITH FOREIGN CREDIT CARD

If you are a foreign renter with a Visa or MasterCard credit card (in a currency other than the Euro), you can benefit from the exchange rate for your card’s currency when you pay the rental. In this case, Ilha Verde will ensure the currency conversion, using an exchange rate based on the index mentioned in the purchase receipt.

If, for any technical reason, Ilha Verde is unable to provide this service, or if a VISA or MasterCard cardholder chooses to pay in Euros, the conversion to the card’s currency will be made in accordance with the conditions of your bank.

21) ISLAND GREEN POLICY RENT A CAR TO PROTECT MY PERSONAL DATA

Ilha Verde may use any personal information it has provided, including the data of any Authorized Driver, for the purpose of providing rental services, namely to verify identity, to proceed with the collection of values, to monitor fraud and to manage any situations before, during and after the Rental Period.

Ilha Verde may provide your personal data contained in the Rental Agreement and details of the fulfillment of obligations arising therefrom to third parties, such as law enforcement authorities, credit recovery entities (including lawyers) and any other relevant organization.

In case of non-compliance due to non-payment, Ilha Verde may also, if it consents, At the end of this “T & C’s” communicate your personal information to ARAC – Association of Industrial Car Rental without Drivers, for the purposes of insertion in the respective defaulting customer file, which may be accessible to any of its members to help them decide whether to accept it or to any driver identified as a customer. Please note that the signing of the Rental Agreement is not dependent on your consent to use, in any way, in non-compliant customer databases and your communication to ARAC, of ​​the personal data provided under this agreement. Ilha Verde collects and processes data for the purpose of providing vehicle rental services and for marketing purposes such as promotions and for the purposes of the customer loyalty program. You will be informed of any personal information that must be collected by Ilha Verde at the station or online, by means of an asterisk *. Some of the recipients of the data collected may be located in countries where the legislation on personal data does not provide a level of protection equivalent to the standards of Portuguese law and the National Data Protection Commission (CNPD).

Please note that, under the law, you may have the right to access, rectify, oppose, limit and delete any data that concerns you. You can exercise this right by accessing customerservice@ilhaverde.com or by sending to Campo de São Francisco nº 9 9500-153 Ponta Delgada. Under the terms of the law and in order to prevent associated risks, Ilha Verde has the right to refuse to rent a car to people who do not offer guarantees of compliance with the contract. For this purpose, Ilha Verde also uses the data and information collected within the scope of the Rental Contract for the preparation of a Customer Observation List. The inclusion of a customer in such a List implies the unavailability of Ilha Verde for the conclusion of any reservation or rental within the scope of the respective account. The inclusion of an account on the Watch List may occur as a result of any of the following situations:

  • Lack of timely payment for services contracted with Ilha Verde;
  • Occurrence of a claim with the Vehicle, due to the driver’s fault;
  • Return of the Vehicle after the contracted term;
  • Violation of any rules for the use of the Vehicle, contained in these Terms and Conditions;
  • Verification of inappropriate conduct with employees and / or in Ilha Verde facilities.

Ilha Verde expressly informs you of the placement on the Watch List. You can only enter into new rental contracts with Ilha Verde when your account is removed from the Watch List, by resolving the underlying situation, according to the criteria internally defined by Ilha Verde.

The Observation List is prepared and maintained by Ilha Verde only for internal use of client management, and such data is not shared with external entities, without prior authorization.

By accepting the present “T & Cs”, you acknowledge that you have given your explicit consent to the aforementioned privacy policy.

22) ELECTRONIC EQUIPMENT

To maintain and protect the Vehicle and to prevent and detect criminal practices, Ilha Verde may use electronic devices, geo-located, to monitor the status, functionality and operability of the Vehicle and / or to detect its movements. This information can be used during and after the Rental Period.

Under the terms of the Portuguese Data Protection Law, you will have the right to access, rectify and delete any data that concerns you. You can exercise this right by accessing customerservive@ilhaverde.com, or by sending to Campo de São Francisco nº 9 9500-153, Ponta Delgada. The vehicles can also be equipped with a NAV device (GPS), so it is obliged to ensure its correct operation and conservation, and the Green Island can debit the cost of the same in case of disappearance or damage.

23) LITIGATION CASE RELATED TO RENT

a) Applicable law

In the event of a dispute between the tenant and Ilha Verde regarding the rental, the applicable law will be Portuguese.

b) Customer services

Regardless of where you have signed the Rental Agreement, you can contact Customer Service at customerservice@illhaverde.com, or at Campo de São Francisco nº 9, 9500-153 Ponta Delgada.

c) Notifications

All notifications to be made under the Rental Agreement must be sent to the addresses contained therein, recognized by both of them as being the agreed address for all legal purposes, being obliged to report any changes.

We check the handwritten signature affixed digitally or by any biometric, digital or electronic means, evidential strength identical to that of a written document, under the terms of the law, with the signature carried out in those terms the same validity as the handwritten signature.

d) Jurisdiction and Venue

Either party can submit the dispute resolution to the competent Courts, which may be those of his residence, without prejudice to being able to address the indicated alternative dispute resolution entities: https: //www.livroreclamacoes.pt, or Consumer Portal at http://www.consumidor.pt/, to which Ilha Verde is not linked, except in consumption conflicts up to the value of Euros 5,000.00. e) Contract documents

The mandatory and binding documents between the Lessee and Ilha Verde are, in order of priority, the following:

  • The Rental Agreement and respective specific clauses,
  • These T & Cs and their attachments,
  • The Ilha Verde Insurance and Products Guide,
  • The Recommended Cost Tariff,
  • The confirmation email you received when you booked the car.

24) THERE IS SOME CODE OF CONDUCT APPLICABLE TO THE CAR RENTAL INDUSTRY?

[ ] I understand that the Vehicle may be equipped with a geo-location device (GPS) that can be used in case of breach of contract or theft.

[ ] I authorize that, in case of non-compliance, my personal data are communicated to ARAC (Association of Car Rental Industry without driver) for inclusion in non-compliant databases and later dissemination by associated companies.

[ ] I do not authorize my data to be used for direct marketing purposes. (LR)
